1. Agreement
These Terms of Service ('Terms') constitute a legally binding agreement between you and Delegate Family Finance GmbH regarding your access to and use of the Ksonia application, website and related services (collectively, the 'Services').
By creating an account, accessing or using the Services, you confirm that you have read, understood and agree to be bound by these Terms.
If you do not agree with these Terms, you must not access or use the Services.
2. Acceptance of the Terms
2.1 Eligibility
You must have legal capacity to enter into binding agreements under the laws applicable to you.
If you use Ksonia on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
2.2 Updates
Ksonia may modify these Terms from time to time. Updated versions become effective upon publication unless a later effective date is specified.
Where required by applicable law, we will provide additional notice before material changes become effective.
3. Definitions
3.1 Services
The Services include the Ksonia mobile application, website, AI-powered document analysis, translations, summaries, deadline extraction, question answering and related functionality.
3.2 Account
An Account is your registered user profile used to access the Services.
3.3 AI Services
AI Services means any functionality that generates explanations, translations, summaries, suggested replies or other content using artificial intelligence.
3.4 Credits
Credits are virtual usage units that may be purchased, granted or included with a subscription and are consumed when using paid AI features.
4. User Accounts
4.1 Account Registration
Some features of the Services may be used without registration. Access to additional functionality may require you to create an Account.
You agree to provide accurate, current and complete information during registration and to keep your Account information reasonably up to date.
Ksonia may refuse registration or restrict the creation of additional Accounts where reasonably necessary to prevent fraud, abuse, circumvention of usage limits or violations of these Terms.
4.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for taking reasonable steps to protect access to your Account and device.
You must notify Ksonia without undue delay if you become aware of unauthorized access to your Account or any other security incident relating to the Services.
Ksonia will not ask you to disclose your password by email, telephone or ordinary support correspondence.
4.3 Use of Your Account
Your Account is intended for your own use unless Ksonia expressly provides functionality that allows use by an organization, team or authorized representative.
You must not sell, transfer, rent or otherwise make your Account available to another person without Ksonia's prior written permission.
You are responsible for activity performed through your Account unless that activity results from circumstances for which you are not responsible under applicable law.
4.4 Organizational Accounts
Where an Account is connected to a company, employer or other organization, additional rules, permissions or commercial terms may apply.
An organization may control access to credits, workspaces or features that it purchases or assigns to its members.
Unless otherwise agreed, each user remains responsible for the documents and information that the user submits through the Services.
5. Description and Scope of the Services
5.1 General Functionality
Ksonia is a document-assistance service designed to help users organize, understand and work with personal and business documents.
Depending on the available features, the Services may allow you to scan or import documents, organize them into cases, obtain plain-language explanations, translate content, identify possible deadlines or actions, prepare suggested replies and ask questions about documents.
5.2 Feature Availability
The functionality available to you may depend on your device, operating system, country, Account status, subscription, available Credits, organizational access and the current version of the Services.
Ksonia may introduce, modify, suspend or discontinue features where reasonably necessary for technical, security, legal, operational or commercial reasons.
Where a change materially affects a paid feature, Ksonia will provide any notice or remedy required by applicable law.
5.3 Documents Stored on Your Device
Ksonia may store documents, document images, extracted text, AI results and related case information locally on your device.
You are responsible for maintaining appropriate device security and, where important, keeping independent copies of documents that you cannot afford to lose.
Deleting the application, resetting the device, losing access to the device or clearing application data may result in the loss of locally stored content.
5.4 Third-Party Services
Certain functionality may depend on third-party providers, including artificial-intelligence providers, payment processors, identity providers, application stores, hosting services and device operating systems.
The availability and performance of those services may affect the operation of Ksonia.
Third-party services may also be governed by their own terms and privacy policies.
5.5 No Substitute for Official Delivery Channels
Ksonia does not replace official postal, electronic, court, administrative, banking, insurance or other document-delivery systems.
You remain responsible for checking the original document and any official communication channel through which notices, decisions, deadlines or requests may be delivered.
6. AI-Generated Information and Important Limitations
6.1 Nature of AI-Generated Results
Some features use artificial intelligence to analyze documents and generate explanations, summaries, translations, suggested actions, deadlines, replies and answers.
AI-generated results are produced automatically and may be incomplete, inaccurate, outdated, misleading or unsuitable for your particular circumstances.
The same or similar input may produce different results at different times.
6.2 Your Responsibility to Verify Results
You must review AI-generated results against the original document before relying on them or taking action.
You should independently verify names, dates, amounts, account details, reference numbers, deadlines, legal consequences, addresses and required actions.
You must not rely solely on a notification, extracted deadline, summary, translation or suggested reply generated by Ksonia where an error could cause financial, legal, medical, administrative or other significant harm.
6.3 No Professional Advice
Ksonia provides document-assistance and informational tools. It does not provide legal, tax, financial, medical, immigration, insurance or other regulated professional advice.
AI-generated information does not create a professional-client relationship between you and Ksonia, Delegate Family Finance GmbH or any technology provider used by the Services.
You should obtain advice from a suitably qualified professional where your situation requires professional judgment or where important rights, obligations, deadlines or consequences are involved.
6.4 Translations
Translations generated through the Services are provided for convenience and may not preserve every legal, technical or contextual meaning contained in the original document.
The original-language document remains the authoritative source unless an authorized body or qualified professional confirms otherwise.
Certified or official translations must be obtained separately where required.
6.5 Deadlines and Suggested Actions
A deadline or action identified by Ksonia may be calculated incorrectly, may depend on facts that are not visible in the document or may be subject to special rules, extensions, holidays, service dates or procedural requirements.
You remain responsible for confirming all deadlines and completing required actions on time through the appropriate official channel.
Adding a date to a calendar or receiving a reminder does not guarantee compliance with a deadline.
6.6 Suggested Replies
Suggested messages, letters and replies are drafts only.
You are responsible for checking, editing and approving every communication before sending it.
Ksonia does not send a suggested reply on your behalf unless the Services clearly provide such functionality and you expressly authorize the relevant action.
7. User Responsibilities
7.1 Lawful Use
You agree to use the Services only for lawful purposes and in compliance with applicable laws and regulations.
You are solely responsible for your decisions, actions and communications made using information generated by the Services.
7.2 Prohibited Conduct
You must not use the Services to commit fraud, impersonate another person, violate intellectual property rights, distribute malware, interfere with the operation of the Services or attempt unauthorized access to any system.
You must not use Ksonia to generate unlawful, abusive, defamatory or intentionally misleading content.
7.3 Responsibility for Documents
You are responsible for ensuring that you have the legal right to upload, process and use every document submitted through the Services.
You remain solely responsible for complying with confidentiality obligations, contractual restrictions and applicable laws relating to documents that you submit.
8. User Content and Documents
8.1 Ownership
You retain ownership of the documents and other content that you submit to the Services.
These Terms do not transfer ownership of your documents to Ksonia.
8.2 Permission to Process
By using AI-powered features, you authorize Ksonia to process the submitted content to provide the requested functionality.
Processing may involve trusted technology providers acting on behalf of Ksonia in accordance with the Privacy Policy.
8.3 Backups
Unless Ksonia expressly offers cloud storage or backup services, you are responsible for maintaining your own copies of important documents.
Ksonia is not responsible for the loss of locally stored documents resulting from device failure, accidental deletion, software errors or similar events.
9. Credits, Billing and Subscriptions
9.1 Credits
Certain AI-powered features require Credits.
Credits may be granted, purchased or included in a subscription depending on the commercial offering available in your region.
9.2 Credit Consumption
Credits are deducted when paid AI functionality is used.
The number of Credits consumed may vary depending on factors including document size, document complexity, AI model usage, processing costs and future pricing changes.
9.3 Subscriptions
Subscription plans may include recurring allocations of Credits and access to additional functionality.
Subscription billing, renewal, cancellation and refunds may be governed by the rules of the relevant application store or payment provider.
9.4 Pricing
Ksonia may modify prices, Credit allocations or commercial plans in the future.
Changes will not affect transactions already completed unless required by applicable law.
9.5 Refunds
Refund rights are determined by mandatory consumer-protection law and, where applicable, by the policies of the payment provider or application store through which the purchase was made.
Nothing in these Terms limits any non-waivable rights granted to consumers by applicable law.
10. Intellectual Property
10.1 Ownership of the Services
The Services, including their software, design, user interface, trademarks, logos, graphics, databases and other intellectual property, are owned by Delegate Family Finance GmbH or its licensors and are protected by applicable intellectual-property laws.
These Terms grant you a limited, non-exclusive, non-transferable and revocable right to use the Services for their intended purpose.
10.2 Restrictions
You must not copy, modify, reverse engineer, decompile, distribute, sell, sublicense or create derivative works from the Services except where such restrictions are prohibited by mandatory law.
You must not remove copyright notices, trademarks or proprietary notices from the Services.
11. Availability of the Services
11.1 Service Availability
Ksonia aims to provide reliable access to the Services but does not guarantee uninterrupted, continuous or error-free operation.
Maintenance, security updates, infrastructure failures, network interruptions, third-party outages or events beyond our reasonable control may temporarily affect availability.
11.2 Changes to the Services
Ksonia may improve, replace, modify or discontinue features where reasonably necessary for technical, legal, security or business reasons.
Nothing in these Terms guarantees that every feature will remain permanently available.
12. Disclaimer of Warranties
12.1 Services Provided 'As Is'
To the maximum extent permitted by applicable law, the Services are provided on an 'as is' and 'as available' basis.
Ksonia does not guarantee that the Services will always be uninterrupted, accurate, complete, secure or suitable for every particular purpose.
12.2 AI Output
Artificial-intelligence output is generated automatically and should not be treated as an official interpretation of any document.
Ksonia does not warrant that AI-generated explanations, summaries, translations, deadlines, suggested replies or answers are complete, accurate or legally correct.
13. Limitation of Liability
13.1 General Limitation
Nothing in these Terms excludes or limits liability where such exclusion is prohibited by mandatory law.
Subject to applicable law, Ksonia shall not be liable for indirect, incidental, consequential, special or punitive damages, including loss of profits, business opportunities, goodwill, reputation or data.
13.2 User Decisions
You remain solely responsible for decisions made on the basis of documents, AI-generated information or suggested actions.
Ksonia is not responsible for missed deadlines, legal disputes, administrative decisions, financial losses or other consequences resulting from your reliance on AI-generated content without appropriate verification.
13.3 Maximum Liability
Where permitted by applicable law, Ksonia's total liability arising from or relating to the Services shall not exceed the amount paid by you to Ksonia during the twelve months preceding the event giving rise to the claim.
14. Indemnification
You agree to indemnify and hold harmless Delegate Family Finance GmbH, its directors, employees and contractors from claims arising from your unlawful use of the Services, your violation of these Terms or your infringement of the rights of another person, to the extent permitted by applicable law.
15. Suspension and Termination
15.1 Suspension
Ksonia may temporarily suspend access where reasonably necessary to investigate suspected fraud, abuse, security incidents, legal violations or technical threats.
15.2 Termination
You may stop using the Services and delete your Account at any time.
Ksonia may terminate or restrict access where you materially violate these Terms or where continued provision of the Services would be unlawful.
15.3 Effect of Termination
Termination does not affect rights and obligations that by their nature survive termination, including provisions relating to liability, intellectual property and dispute resolution.
16. Governing Law and Dispute Resolution
16.1 Governing Law
These Terms are governed by the substantive laws of Switzerland, excluding conflict-of-law rules, unless mandatory consumer-protection law provides otherwise.
16.2 Jurisdiction
Unless mandatory law requires another forum, the courts having jurisdiction over the registered office of Delegate Family Finance GmbH shall have exclusive jurisdiction over disputes arising from these Terms.
16.3 Mandatory Consumer Rights
Nothing in these Terms limits or excludes mandatory rights that consumers enjoy under applicable law.
17. Miscellaneous
17.1 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
17.2 No Waiver
Failure by Ksonia to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other right.
17.3 Assignment
You may not assign or transfer your rights or obligations under these Terms without Ksonia's prior written consent.
Ksonia may assign these Terms in connection with a merger, acquisition, corporate restructuring or transfer of the Services.
17.4 Entire Agreement
These Terms, together with the Privacy Policy and any additional terms expressly incorporated by reference, constitute the entire agreement between you and Ksonia regarding the Services.

19. Final Provisions
By using the Services, you acknowledge that you have read and understood these Terms of Service.
If you do not agree with these Terms, you must discontinue use of the Services.
